MINUTES OF February 14, 2008

 

               

                Council President, Steven Schwenk at 7:30pm, called the Schwenksville Borough Council Meeting of February 14, 2008 to order.

 

Present: Steven Schwenk, Rudy Micsko, Arthur Fairclough, Ray Yeanish and Mayor Joe Giunta.

 

 Absent:

               

PLEDGE OF ALLEGIANCE:  By the assembly.

 

MINUTES:  Dispense with the reading of the Minutes of January 7, 2008 and January 10, 2008. MOTIONED BY RAY YEANISH AND SECONDED BY RUDY MICSKO.  IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF January 7, 2008 and January 10, 2008. ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

 

 

Approval of the Minutes of January 7, 2008 and January 10, 20008

 MOTIONED BY RAY YEANISH AND SECONDED BY STEVE SCHWENK. IT WAS VOTED TO APPROVE THE MINUTES OF January 7, 2008 and January 10, 20008. ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

 

Steve Schwenk also had information from the February 11, 2008 meeting is which Joe Giunta resigned his Council seat and then was appointed Mayor.

 

Arthur Fairclough was appointed to the Authority Board.  Kevin Downes was appointed to the Zoning Hearing Board.  Ray Yeanish was appointed to the Streets and Roads Committee. Steve Schwenk was appointed to the Regional Planning commission and Tom Snyder Jr. was appointed to the Open Space Committee

 

Steve introduced Dr. Edwin Coyle Interim Superintendent for Perkiomen Valley School District.  Dr. Coyle gave an update on the board looking for a superintendent. 

In December Dr. Coyle proposed we ship about 125 students from Skippack to Schwenksville elementary.  One school in Skippack has 860 students with lunch starting at 10:30am with the last lunch at 1:00pm.

 

Dr. Coyle also talked about the Perkiomen Valley Board of Education forming a Task Force and that the Council will be receiving a letter inviting anyone to come to the meeting on Tuesday February 26, 2008 @ 7:30pm at the High school auditorium.

 

 

Steve thanked Dr. Coyle for coming this evening to talk to Council.

 

 

Steve Schwenk reported a vacancy on Borough Council and is happy to entertain a motion to fill the vacancy.  Rudy Micsko would like to make a motion we appoint Lee Ann Miller to fill the vacancy, seconded by Arthur Fairclough. No other nominations.  All were in favor and the motion carried.

 

Tax Collector position:  Letters of resignations from Tracy Yeanish and Jeanette Yeanish were read by Bob Umstead. Rudy Micsko moved to accept the resignations as of January 31, 2008, seconded by Arthur Fairclough.  All were in favor

Appointment of Tax Collector –

 

Bob Umstead read Resolution 2008-03:

 

Whereas, the elected Tax Collector of the Borough of Schwenksville has resigned that position effective January 31, 2008……………………..Now , therefore be it resolved that the Schwenksville Borough Council hereby, appoints Wendi Rowley, 171 Fourth Street, Schwenksville, PA to the position of Tax Collector in accordance with the Borough Code. Adopted this 14th day of February, 2008 by the Council of the Borough of Schwenksville.

 

RUDY MICSKO MADE A MOTION TO ACCEPT THE RESOLUTION AS READ BY BOB UMSTEAD, SECONDED BY ARTHUR FAIRCLOUGH.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

Arthur also stated that this is a temporary appointment that is good until the first Monday of January 2010.  If Wendi desires to continue as tax collector she must run in the 2009 primary and then again in the November election.

 

Rudy Micsko would like to state for the record that he is happy to have Wendi aboard, “She has done some work for me preparing tax returns and I believe that she is a competent individual, learns quickly and is a dedicated person and I think she will do an excellent job for the Borough.”

 

 

ACCOUNTS PAYABLE: Gail Phillips

 

Statement of Revenues/Expenditures to Budget Comparison for January 2008 was presented to council for their approval Monthly Council Cash Available Report as of February 14, 2008.

 

Bills totaling $28,163.15 have been paid from the General Fund

 

Bills totaling $1,091.34 have been paid from the Liquid Fuels Fund

 

 

MOTIONED BY RUDY MICSKO AND SECONDED BY ARTHUR FAIRCLOUGH. 

IT WAS VOTED TO ACCEPT THE ACCOUNTS PAYABLE REPORT AS PRESENTED.

ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

ENGINEER’S REPORT: Perkiomen Trail Gateway - the submitted bonds and insurance coverage of the low bidder, Superior Lawn Service, Inc. are being reviewed for completeness.  We are also waiting for the required construction schedule and anticipated everything will be in place for Council signatures on the contract document within the next two weeks.

SOLICITOR’S REPORT:

 

Perkiomen Trail House Project – Perkiomen Trail House – Planning Commission has recommended to Council that the Plan be denied.

 

MOTIONED BY RAY YEANISH AND SECONDED BY RUDY MICSKO THAT THE BOROUGH COUNCIL DENIE THE PERKIOMEN TRAIL HOUSE PLAN IN ACCORDANCE TO THE DIRECTION OF KEN YERGER’S LETTER DATED JANUARY 9, 2008 AND THE LETTER FROM MONTGOMERY COUNTY PLANNING COMMISSION DATED JANUARY 15, 2008.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

 

Bob Brant will right a detailed letter to the developer.

 

 

Ordinance #347

 

Ordinance #347 has been drafted and advertised for consideration by Borough Council. This Amendment exempts certain condominium associations and rental properties with 15 or more units from the provisions of the Ordinance.

 

MOTIONED BY RAY YEANISH AND SECONDED BY STEVE SCHWENK TO ADOPT ORDINANCE #347.  VOTE COUNT – Arthur Fairclough – yes, Steve Schwenk –yes, Ray Yeanish –yes, and Rudy Micsko-yes.  Motion carried.

 

 

Bob Brant had written a letter requesting certain information from the EDC.  An email from Gib Williams was handed out to Council. 

 

A discussion was held and Council needs Bob Brant to take legal action. The properties that the EDC owns will probably end up in a foreclosure.  The Council rejected the plan from the developer. The money the Borough put into the project may not be recouped.

 

MOTIONED BY RAY YEANISH AND SECONDED BY STEVE SCHWENK TO AUTHORIZE BOB BRANT TO TAKE LEGAL ACTION AGAINST THE PERKIOMEN VALLEY ECONOMIC DEVELOPMENT CORPORATION. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Borough should have a Road master to have the authority to make decisions on matters during emergencies. No decision made will hold until the March Council meeting.

BOROUGH MANAGER REPORT – Bob Umstead

 

Community Development Block Grants (CDBG) – Council will be receiving information from Bob on the CDGB. The filing date is April 1, 2008.

 

Property and Liability Insurance - PRIMA is Pennsylvania Intergovernmental Risk Management Association. Presently the Borough has Selective Insurance. 

 

I move to enter into an Intergovernmental Agreement with PIRMA after Solicitor Brant has approved the agreement, to authorize the advertisement of an ordinance authorizing the Intergovernmental Agreement, and once these are completed and the ordinance adopted, sign a proxy designating Robert T. Umstead as the Borough representative to the PIRMA pool.  I further move that a check be issued to PIRMA in the amount of $8,599.13 and a check to Amerihealth in the amount of $2,775.51.

Motioned by Ray Yeanish and seconded by Rudy Micsko to accept Bob’s recommendation.  All were in favor and the motion carried.

 

COMMITTEE REPORTS

 

STREETS AND ROADS: Ray Yeanish, storm sewers need to be cleaned.

               

FINANCE: Rudy Micsko, some review of Quick Books has been done.  Upgrade for secretary’s computer and add a laser printer.  Motion to upgrade and buy laser printer not to exceed $1,000.00 by Ray Yeanish and seconded by Arthur Fairclough.  All were in favor and the motion carried.

 

PROPERTY: Lee Ann Miller, NO REPORT

               

STREET LIGHTING: Ray Yeanish, NO REPORT

 

MAYOR’S REPORT: NO REPORT

 

OLD BUSINESS: NONE

 

NEW BUSINESS:  Resolution 2008-02 Schwenksville Borough agrees to waive member contributions to the police pension plan. 

 

A letter for the Auditors from Borough Council that the records reflect all assets, liabilities, receipts and expenditures needs to be signed by Council President.       

 

Historical Preservation Committee - Chris Kraft, Roy Miller and Tom Snyder Jr.

 

AUDIENCE: Roy Miller 320 Centennial St.  Ches-Mont has been using Boyer Lane; Bob has sent a letter asking that they not use it.
