MINUTES OF October 21, 2004
The Schwenksville Borough Council Meeting of October 21, 2004 was called to order by Council President, H. Gilbert Williams at 7:00 pm.
Present were: H. Gilbert Williams, Barbara Slater, Gene Frantz, and Raymond Yeanish & Mayor Carroll Rosenberger. Absent was Donald A. Whitko.
PLEDGE OF ALLEGIANCE: By the assembly.
MINUTES: Dispense with the reading of the Minutes of September 9, 2004: MOTIONED BY GENE FRANTZ AND SECONDED BY RAY YEANISH. IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF SEPTEMBER 9, 2004. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Approval of the Minutes of September 9, 2004:
MOTIONED BY RAYMOND YEANISH AND SECONDED BY GENE FRANTZ. IT WAS VOTED TO APPROVE THE MINUTES OF SEPTEMBER 9, 2004. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Presented to council for their approval: Statement of Revenues/Expenditures to Budget Comparison to September 30, 2004. Monthly Council Cash Available Report as of September 30, 2004. Everything is paid to date. Copies of all these reports are on file at the Borough hall Office.

ENGINEER’S REPORT: Adam Supplee – No Report
SOLICITOR’S REPORT: Loren Szczency (see report)
Bass Subdivision: Guest, Tom Pettine
Final Plan went before the Planning Commission at the September meeting and the Planning Commission recommended final approval of the Bass Sub-Division with a couple of conditions, and things for council to consider. To comply with all the comments that Ken Yerger had in his letter of August 30, 2004. That the developer agreed to a covenant against the properties to prohibit the garages from being converted to livable spaces that they include the landscaping to be approved by the Borough Engineer. Enter into a shared driveway agreement. Obtain all outside agency permits. Enter in to any other agreements for public improvements. Post security to see that those permits go in.
MOTIONED BY RAY YEANISH AND SECONDED BY GENE FRANTZ FOR THE BASS SUB-DIVISION ALONG WITH THE FINAL APPROVAL SUBJECT TO THE 6 CONDITIONS THAT WERE LAYED OUT BY LOREN. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Fire Company Resolution: MOTIONED BY RAY YEANISH AND SECONDED BY BARBARA SLATER FOR SCHWENKSVILLE BOROUGH COUNCIL ACKKNOWLEDGING THE IMPORTANT ROLE OF THE SCHWENKSVILLE FIRE COMPANY FUNDING, AND RECOGNIZING THE SCHWENKSVILLE FIRE COMPANY AS AN ITEGRAL PART OF THE BOROUGH’S PUBLIC SAFETY AND HEALTH PROGRAM. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Fire Company: Open Burning Ordinance
MOTIONED BY GENE FRANTZ AND SECONDED BY RAY YEANISH TO AUTHORIZE TO ADVERTISE THE OPEN BURNING ORDIANCE OF 1994 TO DEFINE “RECREATIONAL BURNING”. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Fire Company: Smoke detectors. 3 per house, $10 apiece for the detectors.
3 inter-connected per apartment $1,000 for electrician to wire it in. Fire Company applied for Federal Grant. 1000 smoke detectors and 9 volt batteries to be distributed through the borough for free.
Trash Program: Borough will send out specifications to haulers for trash contracts through the month of November and award contract in December.
MOTIONED BY GENE FRANTZ AND SECONDED BY BARBARA SLATER TO ADVERTISE THE AMENDMENT TO THE TRASH ORDINANCE. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Codification: Planning Commission reviewed the code book. Need to advertise a notice that the Borough intends to adopt its codification giving everyone 30 days to comment on the code book. Copies of code book for review are at Borough Hall.
MOTIONED BY BARBARA SLATER AND SECONDED BY RAY YEANISH TO PUBLISH A NOTICE OF INTENT TO ADOPT THE CODE BOOK. ALL WERE IN FAVOR AND THE MOTION CARRIED.
POLICE REPORT: Chief Timothy Hoppes
Calls for the Month of September: State Police Calls: 30
Local Calls: 32
New barricades are in place for Park Ave. When flooding occurs.
Tim has also assumed the responsibility for the Schwenksville Web page.
Library will be giving out free flu shots on October 26, 2004.
Ray Yeanish also wanted to thank Chief Hoppes for helping to save his building during a fire at his business.

AMBULANCE REPORT: Bruce McBain – Calls 31
Membership drive 2005
New Members are being sought for the Lower Frederick Ambulance Corps.
Mr. McBain also asked if they could be included in the budget. Loren will look into this.
BOROUGH MANAGERS REPORT: Tom Snyder
Wall on Montgomery Ave. is being rebuilt.
Council has a letter from Linda Keh’s about flooding. This is being taken care of.
Carol Rosenberger is having a drainage problem caused by Garris subdivision. This is being taken care of.
Jones’s wall should be started shortly.
Stairs on Centennial Street do in anytime.
Third street stairs and tree – done by fall.
Plan on the removal of the Berm at Main Street Market. Owner will be shown the plan and when he signs off it will be removed.

Potential pedestrian bridge from Meadow Park to Pennypacker Park.
Second bridge will be delivered to Park Ave. October 29, 2004. Or November 5, 2004. Park Ave. will be closed during this time.

STREET LIGHTING: Ray Yeanish – No report
MAYOR’S REPORT: Halloween Parade resolution
MOTIONED BY BARBARA SLATER AND SECONDED BY RAY YEANISH IT WAS VOTED TO AUTHORIZE THE HALLOWEEN PARADE FOR OCTOBER 28, 2004. ALL WERE IN FAVOR AND THE MOTION CARRIED.
OLD BUSINESS: The drainage of Boyer Alley, Centennial Street and Fourth Streets. Adam explained the plan to Council.
Ice is a problem on Centennial Street and needs to be addressed. Borough council approved Tom to talk with Loren and Ken and have a hard plan to bring back to Council at the November meeting.
Establish a New Officer for the Police Pension Fund:
MOTIONED BY BARBARA SLATER AND SECONDED BY RAY YEANISH TO APPOINT GAIL PHILLIPS THE NEW OFFICER FOR THE POLICE PENSION FUND. ALL WERE IN FAVOR AND THE MOTION CARRIED.
AUDIENCE: Joe Sztenderowicz 381 Cherry Street. Paving of driveway
At the Zoning Hearing in 1988 the paving of the driveway can not be done until the Borough plans and goes ahead with correcting the drainage problem.
As of tonight Tom will schedule the surveyor to determine the points of access. The Borough Engineer will provide grade and access plan for the driveway to Boyer Lane.
Joe will be provided with plan when completed.
Joe will provide sketch plan of driveway which will be reviewed by Borough Manager for immediate approval.
Motion made by Gene Frantz was made to adjourn the meeting at 8:45pm., Seconded by Barbara Slater. All were in favor. Meeting adjourned.
