MINUTES OF JUNE 10, 2004

 

            The Schwenksville Borough Council Meeting of June 10, 2004 was called to order by Council President, H. Gilbert Williams at 7:30 p.m.

 

            Present were:  H. Gilbert Williams, Gene Frantz, Donald A. Whitko, Barbara  Slater, and Mayor Carroll Rosenberger.  Absent was Raymond Yeanish.

 

            PLEDGE OF ALLEGIANCE:  By the assembly.

 

            Minute of silence in remembrance of former president, Ronald W. Regan’s passing.

 

            MINUTES:  Dispense with the reading of the minutes of May 13, 2004:  MOTIONED BY DONALD A. WHITKO AND SECONDED BY BARBARA SLATER IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF MAY 13, 2004.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                                 Approval of the minutes of May 13, 2004:

MOTIONED BY DONALD A. WHITKO AND SECONDED BY GENE FRANTZ IT WAS VOTED TO APPROVE THE MINUTES OF MAY 13, 2004.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

            ACCOUNTS PAYABLE AND TREASURER’S REPORT:  Nancy Eppley

 

Tonight the council has for their review a more lengthy report on the check detail (originally call the Disbursements), a deposit detail and a cash report (originally called the Treasurer’s report).

 

MOTIONED BY GENE FRANTZ AND SECONDED BY DONALD A. WHITKO IT WAS VOTED TO ACCEPT THE ACCOUNTS PAYABLE AND TREASURER’S REPORT AS SUBMITTED.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

            Tom Snyder spoke on the Stormwater Model Ordinance.  Will be monitored in September.  Ken Yerger explained fully how this will work.  Loren will be working on an ordinance.  Will be bringing more to the July meeting.

 

98% of the inlets are charted.  Pipes are now underground, they were put in 50-60 years ago.

            When the trash bills go out in July a pamphlet  -  “When It Rains, It Drains” will be going with the bill.

ENGINEER’S REPORT:  Ken Yerger

 

-DEP MS4 Permit:  Assisting the borough in the ongoing work associated with this permit.  The general storm water permit requirements are being phased in over a 5 year period.  The first year report has been submitted.

 

 

 

            SOLICITOR’S REPORT:  Loren Szczesny

 

Public Hearing:  Council recessed  from their scheduled meeting  to hold a hearing on the Natural Resources Protection Standards Ordinance Amendment.

 

The standards set forth regulations/restrictions on development to protect and preserve areas such as steep slopes, ponds, woodlands, streams, and wetlands.

 

Surrounding municipalities are using these standards.

 

This proposed ordinance has been duly advertised. 

 

Audience Comments:  Wendy Rowley, an Open Space Committee member questioned  would there would be any restrictions affecting the proposed Centennial Street Park

Loren answered that there might be some portions of that property where steep slopes exist and that area might have to stay like it is, but other measures such as putting in a trail might be done.

MOTIONED BY DONALD A. WHITKO AND SECONDED BY GENE FRANTZ IT WAS VOTED TO ADOPT THE  NATURAL RESOURCES PROTECTION STANDARDS ORDINANCE AMENDMENT.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

Regular meeting again opened.

 

Uniform Building Code:  This proposed ordinance has been duly advertised and ready for adoption tonight.  There is a deadline for adoption that being July 8, 2004.

 

This basically replaces the BOCA code.  Borough will be using the firm of LTL Consultants as their consultants.

MOTIONED BY DONALD A. WHITKO AND SECONDED BY GENE FRANTZ IT WAS VOTED TO ADOPT THE UNIFORM CONSTRUCTION CODE AS THE MUNICIPAL BUILDING CODE FOR SCHWENKSVILLE BOROUGH.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

Small Borrowing: 

 

There will be signatures required before finalization can take place.  A resolution is here tonight for closure. 

 

Codification of Ordinances:  Loren’s office  has drafted an Ordinance to adopt the Codification of the Ordinances to be designated as “the Code of the Borough of Schwenksville.  A copy of the draft ordinance was forwarded to Ken Yerger and Tom Snyder for review and comment.   

 

Draft Ordinance:  International Property Maintenance Code, passed out for councils’ review.

 

            POLICE REPORT:  Chief Timothy Hoppes

 

Chief Hoppes’s complete report is on file at Borough Hall. 

 

State Police calls for the Month of May:  22

 

Local calls:  26

 

Tim is working on the signs with the public service person.  Tom Snyder said that the signage should be finished by next week.

 

            FIRE COMPANY REPORT:  Jim Keyser

 

10 Calls for the Month of May

 

69 Men in Service

 

5 calls in Schwenksville,   4 calls in Lower Frederick, and 1 call in Perkiomen.

 

There were 27 men in service.  Training included pump operations, search and rescue and car fires.

Dumpster Fires:  At Main Street Market due to overflowing dumpsters.  Time is undetermined when fires started.

 

Wendy Rolley questioned are fire permits needed?  Yes, there is a Fire Marshall.

 

            AMBULANCE REPORT:  No one present,   No report

 

            BOROUGH MANAGER:  Tom Snyder

 

Main Street Repairs:  Should begin in a few weeks.

 

4th Street Lights:  Still working on them.   At the elementary school there is some vandalism going on at the front of the school.

 

Old Post Office Roof:  Tom originally had permission to spend $1,500. on a galvanized colored roof.  This will be blue with a 20 year vinyl coating.  Cost now has escalated to $1,800.

 

MOTIONED BY GENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO AUTHORIZE THIS ADDITIONAL EXPENDITURE OF $300.FOR THE ROOF REPAIRS.  ALL WERE IN FAVOR AND THE  MOTION CARRIED.

 

 

Work at the Park:  Community Service person is cleaning up weeds and has gotten a bad case of poison ivy.  Tom would like permission to spend $504.00  for a certified vegetation management service to spray the poison ivy at the Meadow park.  Ehrlich Company would be contacted.

 

MOTIONED BY DONALD A. WHITKO AND SECONDED BY BARBARA SLATER IT WAS VOTED TO EMPLOY EHRLICH COMPANY TO SPRAY THE POISON IVY.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

Park Board:  Ambler Savings will be fixing the Old Post Office.  But first it must be determined that it definitely is the old post office.  Tom will monitor.

 

Zoning Hearing:  28th of June for Ray Freed.  Will need a Special Exception to put up a garage. 

 

Bass Subdivision:  Tom  has gotten the prints and these will be going to the Planning Commission.

 

Patching Roads:  Repaired 2nd Street pothole.

Park Bench Dedication – Ambler Savings have donated benches in the Borough.

STREET LIGHTING:  Raymond Yeanish   Absent, no report given

 

MAYOR:  Carroll Rosenberger

 

Performed 1 wedding.

 

OLD BUSINESS:  Nothing

 

NEW BUSINESS:  Nothing

 

Concerned about the steps on Third Street property that need to be fixed.  Problem has gone on too long.  Tom said that he is working on this problem.  Carroll would like them fixed before next council meeting.

 

AUDIENCE:

 

Joe Hayes was present with his mother, Catherine Hayes who has had an on going problem with her neighbor,  John Giarroco concerning a shared road.  Mrs. Hayes attorney feels that the borough should get more involved.  Giarroco is blocking the road.  Tom said that this road is not an ordained road but a paper road.

The judge in this case is going to make a recommendation, Carroll suggested that the borough cannot do anything until we have the decision is writing.

Mrs. Hayes has spent considerable monies on this problem.

 

Brian Smith:  150 Third Street

 

Lights with the trail crossing.  PennDot and Perkiomen Township working on this.

 

Wendy Rolley of 4th Street:  Sidewalks??  Developer to take care of.  No timeframe.
