MINUTES OF December 9, 2004
The Schwenksville Borough Council Meeting of December 9, 2004 was called to order by Council President, H. Gilbert Williams at 7:30 pm.
Present were: H. Gilbert Williams, Donald A. Whitko, Ray Yeanish, Gene Frantz & Mayor Carroll Rosenberger.
Absent: Barbara Slater

MINUTES: Dispense with the reading of the Minutes of November 11, 2004: MOTIONED BY GENE FRANTZ AND SECONDED BY DONALD WHITKO. IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF NOVEMBER 11, 2004. ALL WERE IN FAVOR AND THE MOTION CARRIED.

MOTIONED BY RAYMOND YEANISH AND SECONDED BY DONALD WHITKO. IT WAS VOTED TO APPROVE THE MINUTES OF NOVEMBER 11, 2004. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Presented to council for their approval: Statement of Revenues/Expenditures to Budget Comparison to November 30, 2004. Monthly Council Cash Available Report as of November 30, 2004. Copies of all these reports are on file at the Borough hall Office.

ENGINEER’S REPORT: Ken Yerger
Fourth Street/Boyer Alley Drainage:
At the direction of Council we have surveyed the project area for design purposes. We have begun design with the intent to provide the sketch/plan for the installation of the inlet and short piece of storm sewer at Fourth and Centennial prior to completing the remainder of the design. The first phase design will be provided the week of December 13th for the purpose of soliciting quotes.

SOLICITOR’S REPORT: Loren Szczency
Trash Contract – 2005:
Following the discussion at the Borough Council meeting in November, my office finalized the bid specifications and contract forms for the Borough-wide Trash Contract for 2005-2007. A mandatory pre-bid meeting was held on November 29, 2004. Four prospective bidders attended the pre-bid meeting. Three formal bids were received by the Borough and opened on December 3, 2004. Issues with respect to the sufficiency of information provided by the apparent low bidder were raised by one of the other bidders. Upon complete review of the bids submitted, there is a basis for rejecting all of the bids and rebidding for the contract. Under the specifications as drafted, the Borough reserved the right to reject any and all bids received.
Based upon the review of our office and discussions with Tom Snyder, it is our recommendation the three formal bids be rejected, that the Borough revise the specifications to remove some of the unnecessary alternatives to simplify the program and the bidding process, and authorize our office to re-advertise for bids. Pursuing this action will, most likely, require the cooperation of Waste Management in extending its current contract for an additional one month, at least. Waste Management indicated its willingness to cooperate, but the specific terms of the extension have not yet been discussed.

MOTIONED BY DONALD WHITKO AND SECONDED BY GENE FRANTZ TO HAVE ROBERT L. BRANT & ASSOCIATES RE-ADVERTISE FOR TRASH BIDS. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Codification is advertised for the January 13, 2005 meeting.

Raffle Tickets are being sold for $10 a piece and the prize is a 2005 Harley Davidson.

In Memory of Joe Docherty (firefighter) who passed away this year.

MAYOR’S REPORT: Thank you for the steps on 3rd St. that are being done. Complaints about Gentleman at Lumber Yard.
