MOTIONED BY RAYMOND YEANISH AND SECONDED BY GENE FRANTZ IT WAS VOTED TO ACCEPT THE RE-ORGANIZATIONAL PLAN AS OUTLINE IN PREVIOUS YEARS AS FAR AS OFFICERS OF BOROUGH COUNCIL IS CONCERNED. ALL WERE IN FAVOR AND THE MOTOION CARRIED.

The Schwenksville Borough Council Meeting of January 10, 2002 was called to order by Council President, H.Gilbert Williams.
Roll call: Present were: Gilbert Williams, Gene Frantz, Raymond Yeanish and Mayor Carroll Rosenberger. Absent was: Barbara Slater
Pledge of Allegiance: By the assembly.
Dispense with the reading of the minutes of December 13, 2001, December 31, 2001, and January 7, 2002.
MOTIONED BY GENE FRANTZ AND SECONDED BY RAYMOND YEANISH IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF THE ABOVE. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Approval of the minutes of December 13, 2001, December 31, 2001, and January 7, 2002.
Correction to the minutes of December 13, 2001: page 4 2 parcels (should be Miller & Albright) .

ACCOUNTS PAYABLE/TREASURER'S REPORT: Nancy Eppley
Council has received the Deposit Detail for December, Expenditure Report with an additional check written to Thomas Snyder for recording the Hay Subdivision Plan and Mileage to the County. The expenditure report covers the period from January 1 - 11, 2002. Presented the Expenditure/Revenue Report from January 1 until tonight and a Cash Report as of the end of December 2001.

ENGINEER'S REPORT: Robert Flinchbaugh
Perkiomen Valley Elementary School: Plans and calculations were completed and a review letter prepared on December 6th, and forwarded to Council and Planning Commission.

This project proposes the demolition of the existing school and the development of a new school and associated driveway and parking facilities.
No revised plans have been received to date.
Centennial Commons Land Development: A review of the submitted plans and calculations has been completed. A review letter dated December 13th was forward to Council and Planning Commission.
Project proposes the development of 2 apartment buildings and associated driveways and parking facilities.
This project discussed at the December 20th Planning Commission Meeting. No revised plans have been received to date.
Third Street Improvements: A right of way plan and legal description has been prepared for the Frutchey property. This right of way is required for the increase in curb radius being proposed at this intersection. Information forwarded to Tom Snyder.
Mt. View Avenue Culvert Crossing: Plan and legal description has been prepared for the County property, between Main and Perkiomen Creek. An easement is required due to the proposed storm sewer which shall discharge from Main Street. Information forwarded to Tom Snyder.
Montgomery Avenue Ordination: Deed review for all adjoining properties has been completed. Plans and legal description are currently being prepared for the right of way area needed for this ordination.
Telvil: Improvements inspections are continuing as necessary.
SOLICITOR'S REPORT: Loren Szczesny
Perkiomen Valley School District: Lot line adjustment with the Ziegler property must be resolved. There will be a special meeting with PVSD and council on January 31st.
Trail System-Registration of Name: Following up with Wm. Eilberge who is the attorney with whom the borough will apply for and register the name for the trail.
Johnston/Rogers Subdivision: A prepared escrow agreement for the property owners to sign has been prepared along with sufficient financial security to cover the cost of the sidewalk installation. The monies will be held by the Borough until either the sidewalk is installed by the property owners or the Borough utilizes the funds to install the sidewalk on its own.
Centennial Commons Land Development: Loren's office has reviewed the provisions of the zoning order issued back in 1997 and the provisions of the current zoning ordinance governing the expiration of zoning relief previously granted. The developer was advised that the previous zoning relief had expired and that he would be required to return to the Zoning Hearing Board if he wished to pursue his plan as filed.
Sign Ordinance-Non Conforming: Several conversations between Loren's office, Tom Snyder, and Ernie Schmitt have occurred in reference to this non-conforming issue. Discussions have focused on the prohibition of internally illuminated signs and the requirement to comply with current zoning provisions in the event of a change to the face or type of the sign.

Resolution for the Defibrillator: Loren read the resolution acknowledging and honoring Warren Lodge #310 for their contribution to the Schwenksville Borough Police Department.
MOTIONED BY GENE FRANTZ AND RAYMOND YEANISH IT WAS VOTED TO THANK THE WARREN LODGE #310 FOR THEIR CONTRIBUTION OF THE DEFIBRILLATOR TO THE POLICE DEPARTMENT. ALL WERE IN FAVOR AND THE MOTION CARRIED.

NEW BUSINESS: Donald has been an elected auditor in the past. Now, that he has been appointed to council does he still retained this position? No. Council will seek to replace Donald.
Montgomery County Borough's Association Meeting to be held at the Indian Valley Country Club on January 24th. Anyone interested in going contact Nancy.
AUDIENCE:
Richard Spare, Attorney representing Mr. And Mrs. Slemmer on the Miriam Smith estate. Property subdivided into two homes. Work done by builder, Mike Organski. The Slemmers have paid for some engineering and legal work and would like some monetary relief. This discussion has been tabled for later decision.
There will be an Executive Meeting following tonight's meeting.
SPECIAL EVENT: Tom Snyder's Birthday. HAPPY BIRTHDAY TOM AND MANY, MANY MORE. A birthday cake was served to all.

SPECIAL MEETING: Thursday, January 31, 2002
The Borough of Schwenksville Special Meeting was called to order by Council President, H. Gilbert Williams on Thursday, January 31, 2002 at 7:30 p.m.
Roll call: Present: H. Gilbert Williams, Gene Frantz, Barbara Slater, Raymond Yeanish, Donald Whitco and Mayor Carroll Rosenberger.
Pledge of Allegiance: By the assembly.
The purpose of tonight's meeting is to conduct a public hearing to consider an ordinance for adoption and enactment for the zoning district for the proposed new Perkiomen Valley School District.
Mr.Robert Brant conducted the meeting at this point.
This proposed ordinance has been duly advertised in the Norristown Times Herald with Proof of Publication.
The three parcels are described by Borough Manager, Tom Snyder are the North, Albright, School and a small portion of the Ziegler Property.
Montgomery County Planning Commission and Local Planning Commission have given their approval for the proposed adoption.
Changes are from R-2 to Institutional District.
Nothing from the public as far as comment on this subject.
Representatives present are: Jim Mazeika, Kevin Godshall, Dr. Priscilla Feir, and Michael Macaninch, attorney.
MOTIONED BY GENE FRANTZ AND SECONDED BY RAYMOND YEANISH IT WAS VOTED TO ADOPT THE PROPOSED ORDINANCE AMENDING THE ZONING MAP OF THE BOROUGH OF SCHWENKSVILLE AS ADOPTED BY ORDINANCE #258, AS AMENDED, TO RE-ZONE THREE TAX PARCELS FROM R-1 RESIDENTIAL DISTRICT TO IN-INSTITUTIONAL DISTRICT. ALL WERE IN FAVOR AND THE MOTION CARRIED. ALL WERE IN FAVOR AND THE MOTION CARRIED.
Resolution: In reference to PVSDistrict Final Plan Approval subjected to various waivers
Mr. Brant read the resolution(pages 4) copy of which is in the files of Borough Hall and also attached to these minutes.
Questions:
Bob Flinchbaugh: Street Lighting-Not shown on the plan. Bob has recommended model and spacing.
According to Kevin Godshall separate lighting plan exists and is part of the final plan.
Right of Way along 2nd Street. Sidewalk to be located outside of right of way. Was there an access easement, does Council want. Referring to Bob's letter in Jan. page 2. Jim Mazeika addressed this saying that the current right of way is 41' and this would push the sidewalk out of the right of way. Proposing is an additional easement outside of the right of way. If went according to land development and subdivision ordinance the right of way would be pushed back into the site. Refer to Jan. letter.

Chris Detweiler-Perkiomen Avenue: Referring to Waviers 2 and 3. Curbs and Sidewalk. What impact are they going to have on his property along the street for resale value. There are also existing trees in the area, will these trees need to be removed later?
Jim Mazeika said that there is some grading to be done. Sidewalk to be installed along with tree removal. Final complete plan should be out soon. New curb line will be shown.
