BOROUGH OF SCHWENKSVILLE, PA

COUNCIL MEETING OF OCTOBER 11, 2001

 

The Schwenksville Borough Council Meeting was called to order by acting Council President, H. Gilbert Williams at 7:30 p.m.

ROLL CALL: Called by Secretary, Nancy Eppley

Present: H. Gilbert Williams, Patricia Katona, Eugene Frantz, Barbara Slater and Mayor, Carroll Rosenberger.

PLEDGE OF ALLEGIANCE: By the assembly.

Before conducting any regular Borough business tonight it will be necessary to accept the resignation of Bernard McCollum as of last month's meeting.

MOTIONED BY GENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO ACCEPT THE RESIGNATION OF BERNARD McCOLLUM AS COUNCIL PRESIDENT AND AS A MEMBER OF COUNCIL EFFECTIVE SEPTEMBER 13, 2001. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Filling the vacancy as a member of Council: MOTIONED BY BARBARA SLATER AND SECONDED BY PATRICIA KATONA IT WAS VOTED TO APPOINT RAYMOND YEANISH TO FILL THE UNEXPIRE TERM OF BERNARD McCOLLUM. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Filling the vacancy of Council President: MOTIONED BY PATRICIA KATONA AND SECONDED BY BARBARA SLATER IT WAS VOTED TO APPOINT H. GILBERT WILIAMS AS COUNCIL PRESIDENT FOR THE REMAINDER OF THE YEAR 2001. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Filling the vacancy of Vice President: MOTIONED BY GENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO APPOINT EUGENE FRANTZ AS VICE PRESIDENT FOR THE REMAINEDER OF THE YEAR 2001. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Pro-Tem Council: MOTIONED BY PATRICIA KATONA AND SECONDED BY H. GILBERT WILLIAMS IT WAS VOTED TO APPOINT BARBARA SLATER AS PRO TEMP OF COUNCIL. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Dispense with the reading of the minutes of September 13, 2001: MOTIONED BY BARBARA SLATER AND SECONDED BY EUGENE FRANTZ IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF SEPTEMBER 13, 2001. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Approval of the minutes of September 13, 2001: MOTIONED BY EUGENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO APPROVE THE MINUTES OF SEPTEMBER 13, 2001. ALL WERE IN FAVOR AND THE MOTION CARRIED.

ACCOUNTS PAYABLE & TREASURER'S REPORT: Nancy Eppley

Disbursements for period of October 1-11, 2001: $30,026.09. Receipts for the Month of September 2001: $35,633.87. Also, Statement of Revenue and Expenditures from January 1 to October 11, 2001. Documentation has been past out to council members for their review.

Received notification from the Commonwealth of PA Liquid Fuels Account that the Borough will be receiving their allocation in April in the amount of $22,109.34.

Treasurer's Report: As of September 30, 2001 was given to council for their review.

ENGINEER'S REPORT: Robert Flinchbaugh

-Telvil Subdivision: Improvements inspections are continuing. Sidewalk and street lighting is being installed in accordance with the plan and previous discussions/correspondence with the developer.

-Third Street Improvement Projects: As authorized, the plan and bid package have been revised to include all improvements included as part of Alternate B, as outlined in their letter of August 7, 2001.

The surveyor, Jeff Turner will be completing construction stakeout. Preliminary stakeout shall include proposed curb, right of way and storm sewer locations.

-Johnston/Rogers Subdivision: 2 lots (one is 1.2 areas and the other is 1/2 acre approximate) Last revision 10/09/01. Plan to show installation of sidewalks, street trees, monuments and pins. A preliminary resolution was prepared for tonight but will need to be changed.

Angela Montgomery representing the client was also present.

Mentioned that in order for the plan to be in compliance it must meet also:

-LTL's letter of 10/03/01.

-Be in compliance with Montgomery County Planning Commission correspondence.

-Developer to provide signature blocks for owner of property and applicant.

It was questioned by Pat if any more reviews will be required. According to Mr. Brant, no everything seems to be satisfied.

MOTIONED BY PATRICIA KATONA AND SECONDED BY EUGENE FRANTZ IT WAS VOTED TO PRELIMINARY/FINAL APPROVAL TO THE JOHNSON/ROGERS SUBDIVISION. ALL WERE IN FAVOR AND THE MOTION CARRIED.

-Mountain View Avenue: (Culvert Crossing). Plans and bid package have been completed. The bid package has been separated into several contracts, based upon right of way ownership. Now going to PennDot for approval. New meeting will be coming soon.

SOLICITOR'S REPORT: Robert Brant

-Trash Bids: If everything is satisfactory with council authorization can be given to advertise the trash bids so that a bid opening can occur at the November 8, 2001 meeting.

MOTIONED BY EUGENE FRANTZ AND SECONDED BY PATRICIA KATONA IT WAS VOTED TO AUTHORIZE THE SOLICITOR TO ADVERTISE THE TRASH BIDS. ALL WERE IN FAVOR AND THE MOTION CARRIED.

-Regional Planning Commission: This plan was adopted by the Borough as suggested by the Montgomery County Planning Commission. All municipalities will have the same ordinance. Mr. Brant needs authorization to advertise the revised version.

MOTIONED BY PATRICIA KATONA AND SECONDED BY EUGENE FRANTZ IT WAS VOTED TO AUTHORIZE THE SOLICITOR TO ADVERTISE THE REVISED REGIONAL PLANNING COMMISSION ORDINANCE. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Only a summary will be advertised.

McKim Property-Condemnation: A lengthy memo was presented to council for their review. In summary, Mr. Brant suggests that the court rule in this condemnation. It is the conservative way, otherwise, there could be a claim by any heir. Timeframe not a problem.

Zoning Officer, Ernest Schmitt will leave a message on the applicant's phone informing them of this action.

MOTIONED BY EUGENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO HAVE THE SOLICITOR PROCEED WITH THE APPROPRIATE COURT ACTION TO COMDEMN THE McKIM PROPERTY. ALL WERE IN FAVOR AND THE MOTION CARRIED.

According to Borough Manager, Tom Snyder the real estate portion will probably be sold after action is completed.

POLICE REPORT: Chief Timothy Hoppes

Chief Hoppes complete report is on file at the Borough Hall Office. There were 31 incidents that were responded to in the Borough by Chief Hoppes and the State Police responded to 21 for the month.

A copy of a letter from the U.S. Department of Justice to Chief Hoppes thanking him for his application to the Office of Community Oriented Policing Services for funding under the MORE 2001 program. There were many applications and the application was not among those selected in the U.S.Dept. of Justice's announcement, but the application has not been rejected. Additional awards will be given in 2002 and the application may receive further consideration.

EMERGENCY MANAGEMENT COORINATOR: Chief Timothy Hoppes

Emergency Management phone has been installed and is working.

Also, passed out emergency management information forms which need to be filled out by council and borough manager (b.m. has filled out already).

FIRE COMPANY: Eugene Frantz No report

AMBULANCE REPORT: Dolly - representative from the Ambulance Corps

Month of September: 18 calls for Schwenksville

Letter to council stating that the Ambulance Corps would like to thank council for their support in the past. However, expenses exceed revenues. In order to resolve their financial obligation the Lower Frederick Ambulance Corps would like to sit down with council members to address these problems.

ZONING OFFICER: Ernest Schmitt

-For the month of September: 5 U & O's have been issued.

Issued misc. U & O's for shed, addition, repair of a deck.

Only 2 building lots are left at Cedar Lea. These are quality homes, builder has been excellent to work with. Range of homes $160,000.00 to $250,000.00. Lot #6-will be the next house to be built, Lot #4-will be built upon next year.

-Minutes on the Perkiomen Valley School District-Preconstruction Phase Meeting Memo #4 passed out for council's review. All issues will be complied with.

-Attended to zoning matters and has conferred with Borough Manager.

BOROUGH MANAGER: Tom Snyder

Entire report is on file at Borough Hall.

Highlights of report:

-Reply to letters concerning new park: Majority of residents are in favor.

 

Next park meeting: November 7, 2001

-New Park Grant: Tom would like council to grant him permission to apply for a grant up to $20,000.00.

MOTIONED BY PATRICIA KATONA AND SECONDED BY BARBARA SLATER IT WAS VOTED TO ADOPT A RESOLUTION AUTHORIZING THE BOROUGH MANAGER TO MAKE APPLICATION FOR A (MEADOW)PARK GRANT. THIS WILL BE A $20,000.00 GRANT. ALL WERE IN FAVOR AND THE MOTION CARRIED.

(Tom will give resolution information to Nancy Eppley)

-Third Street Maple/Perkiomen Avenue: Awaiting bid package, easements and surveys. There is a possibility of a Penn Vest Grant. There is a tentative meeting scheduled for 10/29/01.

Permission asked by Tom to make this application.

MOTIONED BY GENE FRANTZ AND SECONDED BY BARBARA SLATER IT WAS VOTED TO HAVE THE BOROUGH MANAGER MAKE AN APPLICATION FOR A PENN VEST GRANT FOR THIRD STREET, MAPLE/PERKIOMEN AVENUE. ALL WERE IN FAVOR AND THE MOTION CARRIED.

-Line Marking: Reports favorable on Mine Hill markings. However, some people ignoring markings.

-Storm Sewer: Main & Perkiomen: Emergency repairs to start on 10/22 by Authority and JMG.

-Perkiomen Valley School District contacted Tom today and will give drawings out next Monday. There will be a variance and change scheduled.

-Planning Commission Meeting: Re-schedule from 10/18 to 10/25/01 due to lack of quorum.

COMMITTEE REPORTS

STREETS/ROADS: Barbara Slater Refer to Borough Manager-working closely with him.

FINANCE: Gilbert Williams Nancy, Gene, Tom will be meeting for a Preliminary Budget Meeting in November.

TRAIL & REVITALIZATON: Staking almost finished on the Trail.

Revitalization PLAN Meeting scheduled for October 30, 2001 at 7:30 pm.

PROPERTY: Patricia Katona

Miscellaneous painting outside Borough Hall.

MOTIONED BY PATRICIA KATONA AND SECONDED BY BARBARA SLATER IT WAS VOTED TO AUTHORIZE MINOR PAINTING REPAIRS TO THE OUTSIDE OF BOROUGH HALL BUILDING. NOT TO EXCEED $400.00. ALL WERE IN FAVOR AND THE MOTION CARRIED.

-Well at Pennypacker: Things are going along fine.

FIRE COMPANY LIAISON: Gene Frantz New truck is in. Will talk to Jim Keyser or Scott Angstad about going to press.

STREET LIGHTING: Gene Frantz Nothing to report

 

 

MAYOR'S REPORT: Carroll Rosenberger

Received a favorable report from resident concerning Chief Hoppes, going "beyond the call of duty". Good Job, Tim.

-Halloween Parade: Scheduled for Thursday, October 25, 2001.

OLD BUISINESS: Nothing

NEW BUSINESS: Codification Presentation by Burton Hunt of Penn Valley Publishers. Mr. Hunt's presentation is on file at Borough Hall.

New month council will be hearing another presentation by Warren Elliott of General Code Publishers.

AUDIENCE: Nothing

All business having been completed, the meeting was adjourned at 8:45 p.m.
