MINUTES OF JUNE 10, 1999 BEGAN; 7:30 P.M. ENDED: 9:00 P.M.

The Schwenksville Borough Council Meeting was called to order by Council President, Bernard McCollum.

Secretary, Nancy Eppley called the roll:

Present were: Bernard McCollum, Joan Giunta, Jim Dull, Mayor William Clossin

Absent were: E. M. (Sue) Kuhn and Chris Kraft

PLEDGE OF ALLEGIANCE: By the assembly.

MINUTES: Dispense with the reading of the minutes of May l3th and May 24, l999: MOTIONED BY JOAN GIUNTA AND SECONDED BY JIM DULL IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF MAY 13TH AND MAY 24th 1999. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Approval of the minutes of May l3th and May 24, l999:

MOTIONED BY JOAN GIUNTA AND SECONDED BY JIM DULL IT WAS VOTED TO APPROVE THE MINUTES OF MAY 13th AND MAY 24th, l999. ALL WERE IN FAVOR AND THE MOTION CARRIED.

ACCOUNTS PAYABLE: Gael Hahn

From Liquid Fuels: Expenditures of $169.02

Joan mentioned that there are few additional bills which she would like to see payment made to when these bills are received in the office. They are Carroll Engn. (Tom Snyder to approve first), Keenan, Ciccitto, and Brant, PECO Street Lights (regular service). Deferring payment of B.F.I., will be paid as soon as revenue is received in that account.

MOTIONED BY JOAN GIUNTA AND SECONDED BY JIM DULL IT WAS VOTED TO PAY THE ABOVE BILLS AS THEY ARRIVE AND THE B.F.I. BILL AS SOON AS REVENUES BECOME AVAILABLE. ALL WERE IN FAVOR AND THE MOTION CARRIED.

TREASURER'S REPORT: Gael Hahn

Reports given for the Monthly Revenue and Expense Report (for the Month of May and January to May l999).

Receiving the bulk of the taxes (real estate) now .

Transmittals are being made to the Library and the Fire Company.

POLICE REPORT: Chief Frank Holden

Total incidents for the Month of May: 85

Questioned previously the State Police Reports. Where are they? The reason as stated by Frank is that during the last few months their computer system had been changed over and no one knew how to get the reports out. Gave report to Frank, but no printout. Just tallied out by Frank.

Frank took one week's vacation in the Month of May.

FIRE CHIEF'S REPORT: Nick Matregrano

Month of May 4 calls.

Memorial Day Flea Market and Chili Cook-Off was attended by more people than ever before and is growing each year.

Circus is coming to town on Friday evening, June 25th. Two shows: 5:30 p.m. and 7:30 p.m.

Mayor: Resolution needed? No, this was done as a General Resolution for all Community events.

AMBULANCE REPORT: By Nancy Eppley

An authorized member from the Ambulance Corps could not be present tonight.

Monthly report for the Month of May l999: Schwenksville Borough: l2 calls

Colonnade: 7 calls. Total for the month for Schwenksville and neighboring towns is 65 calls.

SOLICITOR'S REPORT: Robert Brant

Proposed Ordinance: Duly advertised.

Mr. Brant gave a summary of the ordinance proposed. It is an ordinance increasing the Nonelectoral indebtedness of Borough of Schwenksville, Montg. County, PA by the Issuance of a $115,644 General Obligation Note. Series of l999 for and toward financing certain capital projects; fixing the form, date, interest rate and maturity thereof, making a covenant for the payment of the debt service on the note; providing for the filing of the required documents; providing for the appointment of a sinking fund depositary for the note; and authorizing the execution, sale and delivery of the note and other necessary action.

Fund to be established at Union National Bank. There was previously money borrowed in the Infrastructure Loan. Good deal from the county by Mr. Brant.

Joan: Are specific projects identified in the Ordinance?

Bob: Genetic in nature, Deals with Borough Authority water supply and distribution. Debt service $11,564.00 on principle every year for l0 years.

Asked for any questions from council or audience. There were none.

MOTIONED BY JIM DULL AND SECONDED BYJOAN GIUNTA THAT THIS ORDINANCE BE ADOPTED. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Burning Ordinance review:

Adopted in l994, identifies and regulates. Fire Marshall or Police Department can enforce. If someone violates, it can carry a fine.

Open Burning defined as any unclosed fire where smoke, odors are emitted to open air and are not directed thereto through a flue. Ordinance states what can be burned, duties of the Fire Marshall,no refuse by open burning, but list exemptions.

Tom Snyder will get some clarification from B.F.I. on construction material. This will be written.

COMMITTEE REPORTS:

STREETS AND ROADS: Sue Kuhn Absent No Report

FINANCE: Joan Giunta

Discussed the payments which will be needed on the Infrastructure Loans. Be aware when formulating the budget.

Budget for l999 looks good to date.

Mayor: Spending money from General Fund Capital Reserve:

All that is needed is a motion to spend.

Joan: Also, needed to an amendment to the budget. However, Joan cautions that there is 6 months operating expenses in that account, the more is spent the less there is in the reserve.

PARK BOARD: Tom Snyder

No swings on Clearfield Avenue until the fence is around the building. According to Jim Dull, Fred Kehs is supposed to get prices on putting up fences around the pumping stations. A letter will be sent by Nancy to the Authority.

Jim Dull would like permission to use the Park on 6/l9/99 at 2P.M. The American Legion will hold a Flag Retirement Ceremony. Burning of flags that are brought back from the cemeteries Burning Ordinance waived at this time for this event. If there is a fee, Jim will pay. If anyone has an American Flag that they would like to dispose of in a proper manner, please bring it out.

STREET LIGHTING: Chris Kraft Absent No Report

FIRE COMPANY LIAISON: Jim Dull No Report

POLICE COMMITTEE: Joan Giunta

Frank Holden and Joan will be working on Frank's contract on Monday evening at 6:l5 p.m.

BOROUGH MANAGER: Tom Snyder

Highland Terrace work (pillars)is processing along.

Truck signs are in for Perkiomen, Walnut Street, Woodland, 2nd and 3rd St. Sign designated are l0 Ton Limit and Local Delivery only (Walnut, Woodland, 2nd and 3rd, Perkiomen and Centennial will be l0 Ton limit).

Adding signs on Main Street, saying that there is a truck restrictive signs on the various roads. Spoke about Limerick Road: Anyone bringing a truck by way of Township is legal until they get to Limerick Road.

Streets were swept. Low bidder contracted the job to the next bidder.

Bridge is being repaired on Main Street. Some of the sidewalks are pulled out. Some will be patched and some will be replaced. Ordinance on sidewalks calls with replacing with concrete not bituminous concrete. Sidewalk on this side (borough hall side) is worse than what is being torn up. Patch other side and fix depressed curb which is PennDot's problem and according to how the job goes on the other side we might be able to repair work there. Grates will be returned. This is a major job as the "arch" is falling in.

Traffic lines replaced, and more speed bars at 2nd, Summit and Centennial and added more stop bars on State Game Farm Road.

No parking at the MAC sign. There is no parking that side but people park anyway to use the MAC. Frank explained the parking regulations, if a person stops his/her car and goes to the MAC machine there is no violation.

OLD BUSINESS: Nothing

MAYOR'S REPORT: Bill Clossin

Status of Water: Borough of Schwenksville authorized our engineer, Carroll Engineering to review the Borough Authority's engineer, ACER Engineering work and come back with a report. Copies of that report are here for anyone who desires them. Mr. Brant just received the report and hasn't had time to review. Carroll engineers met with Authority Manager, Fred Kehs and Authority members and Tom Snyder. More demand in production facilities and some recommendations. More work will probably be required by Carroll. Discussion on the "Loop". Jim highlighted points to be done: Put pump on line to increase the pressure. ACER coming up with different ways to do this under creek, under bridge. Jim feels under bridge less costly. Also, develop new sources for supply, Jim suggested talking to well diggers and get there ideas. Additional sites (Pennypacker), Authority hasn't come back with an answer.

Tom explained that the Borough Authority applied for permission to go into the park, the park board passed it on with their approval to the county solicitor's office. By way of the Borough Authority's solicitor, they were told that they have to go out for bids. Now the story is changed as of yesterday. Finally, suggested was re-vamping Well #7 at Zieglersville, not producing enough water. Jim again feels that the "loop" would be best.

Mr. Brant mentioned that the Borough Council must act upon these issues in a quick and formal way.

MOTIONED BY JIM DULL AND SECONDED BY JOAN GIUNTA IT WAS MOTIONED THAT THE SCHWENKSVILLE BOROUGH COUNCIL ACT UPON QUICKLY AND IN A FORMAL WAY TO TAKE ACTION. ALL WERE IN FAVOR AND THE MOTION CARRIED.

Mr. Brant will write a letter to the Authority.

Furniture: No action tonight. Will be discussed at the Special Meeting next week.

AUDIENCE:

Roy Miller: The big well on Centennial. Not being considered?

Mayor: This was discussed at the B.A. meeting, has metals, solvents and would have to be treated.

Tom: D.E.P. Well available for emergency use. If used the well would have to have certain things done before it would be used.

Lisa O'Brien: Burning Ordinance

This was previously discussed. Again, Mr. Brant explained the ordinance. The ordinance addresses problems, enforcement.

Bernie checked this problem(s) out and found that the person that was burning was agreeable with the ordinance.

Mrs. O'Brien would like the council to consider a "NO BURNING ORDINANCE"

Mayor: More discussion and have a meeting with those involved.

Bernie: Ralph Rosenberger, Fire Marshall invited to come to the meeting.

Mrs. O'Brien: Will be discussed at another meeting?

Water Problems:

Water Enforcing: Are there any restrictions in the Borough?

Ruth Rhoads? Zieglerville Road: No water/pressure low. Very upset that she got a letter on restricting water. Also, received input from Jeff Holtz, Berger Lane and Derek Dodd of Zieglerville Road. Received notices also. Letter was presented requesting that Lower Frederick have a member on the Authority Board.

Mayor: This problem has not been handled well from the beginning.

Bernie: Members are appointed, the Authority is a separate entity. Counsel has been on this and council has tried to help.

Residents wanted to know who will police the restrictions? For the Borough, the Police Department. Chief Holden cannot go to other townships.
